Over the years, India is witnessing a sharp increase in crimes against humanity. One such menace is mob lynching. Victims don't get justice. Mob violence takes place in various parts of the country in the name of religion, caste. So, what is mob lynching? It means that a group of people come together to kill someone brutally without proper jurisdiction, going against the law and unethically or illegally.
According to the mob, they come together for a good cause; for no reason, they consider themselves great men who are the only ones in the world to look after what is right and wrong. The mob take the law on with the pretext of providing justice; without trial, they torture or mutilate the offender. Spreading of rumours through WhatsApp, the rise of cow vigilante and silence of political class are a few reasons for it. So now the question arises why our country needs laws against this, what is the need?
Mob lynching violates articles 14 and 15 of the Indian Constitution. Lynching based on identity discriminates against a whole community and should be stopped with proper action as it violates the Constitution. Further, there is a widespread prevalence of mob lynching in our country. So we, as responsible citizens of the country, should ensure that there is an anti-discrimination law for the protection of rights.
When there are cases of mob lynching due to the rise of cow vigilantes, it is a clear case of violating the Constitution. In May 2017, the Government imposed a ban on the sale and purchase of cattle to prevent cruelty against the animals. The cow vigilante saw this decision as an opportunity. They started torturing innocent Muslims, accusing them of beef eaters. We have noticed many incidents of people getting stabbed to death only because of suspicion. For example, take the Dadri mob lynching case where the 52-year-old got killed just because of being suspected of slaughtering a cow after stealing cattle. Or even if we take the case of the mob lynching case of Junaid and his two brothers during their train journey. The fellow brothers were denied a seat just because they were Muslims, ate beef and were considered anti-nationals. Such cases undoubtedly prove that mob lynching violates the Constitution as it targeted the Muslim community. We, as citizens of India, should demand stricter laws to protect our Constitution and its regulations.
Many states in our country have strict laws against mob lynching, but what we should demand is a law that prevails in the entire nation.
Over the years, Law and Order have been considered a State object, but it is not that way. Imposing Presidential law in states is due to the failure of constitutional machinery only. So the Union should come up with regulations for the entire country so that the people are afraid of committing crimes nowhere.
Last but not least, India should come up with strict laws to provide a public message that lynching is a crime. Instead of honouring the accused, we should punish them. People should know that everyone has the right to equal protection of laws. Killing someone in the name of religion, caste, or sex does not make sense, and it's high time people realize it. The Supreme Court has mandated the Centre to spread the message through television and print media.
Our country should come up with stringent laws as it is the very need of the nation.
